Will of Hugh Barnett
I, Hugh Barnett, of the County of St. Clair and State of Missouri, being feeble in
health, but of sound mind and disposing memory and having in view the uncertainty
of human life and being desirous in view of the contingency of death, of
disposing of my temporalities in a way most satisfactory to my mind,
do make and ordain this to be my Last Will and Testiment, herby revoking all
others, theretofore made by me.
1st It is my desire that all my just debts and funeral expences be fully met.
2nd I give and bequeath unto my daughter Ellen Cummins wife of John Cummins the
Negro girl which she now has in her possession named Mary about ten years old.
3rd I give and bequeath unto my sons John Barnett and William Barnett jointly my
Negro woman Julia about twenty one years old.
4th I give and bequeath to my daughter Susan Browning wife of Clifton G.
Browning the Negro girl she now has in possession named Malinda about thirteen
years old.
5th I give and bequeath unto my daughter Martha Penn wife of George W.
Penn my Negro boy John about three years old.
6th I give and bequeath unto my daughter Kiziah Moore wife of Alexander D.
Moore my Negro girl called Tuck about seven years old.
7th I give and bequeath unto my son James Barnett my negro boy Bill about five
years old.
8th I give and bequeath all the residue of my estate both real and personal unto
my beloved wife Mary Barnett for and during her natural life to use and dispose
of as she may think best and at her death it is my will that the property shall
then both real and personal be divided between my children Hugh Barnett, Markus
Barnett, Pleasant Barnett, Joseph Barnett and Mary Barnett as follows. Hugh to
have Negro boy Man. Markus to have my Negro Dave. Pleasant to have
my Negro girl Caroline. Joseph to have my Negro girl Dianah and the first child
she may have after this will but should she have more than one at the time of my
wife's death said second child and any others she may have is to become
common stock and to be divided equally amoung my last mentioned children. My
daughter Mary wife of Benjamin Cocke later is to have my Negro boy Tom and my
Negro girl Hannah and it is my desire and request that my wife Mary at any time She may think best to give off
to my children the property herein bequeathed when they become settled and She
may think it to their interest so to do. But nothing herein stated is to deprive
my wife from the use and controll of the property heretofore in this will
bequeathed for and during her natural life and the time that the right of my
last mentioned children to their property is not to occur until the death of my
wife.
9th At the death of my wife it is my will and I do hereby bequeath to my
daughter Martha Penn wife of George W. Penn in addition my Negro man Ephraim.
10th At my death I wish my Negro man Peter sold to the highest bidder and the
proceeds of said sale at my wife's death to be equally divided among my last
mentioned children which last mentioned children means my children who inherit
after their Mother's death.
11th I hereby appoint my wife Mary Barnett and my son John Barnett Executors of
this my last Will and Testament. Given under my hand and seal this 4th day of
February AD 1854.
